Family and Medical Leave Act (FMLA)

Under this Act, employers are not allowed to discriminate against or interfere with an eligible employee’s request for, or previously taken, FMLA leave for acceptable issues related to their family (spouse, child or parent) or personal medical issues. The FMLA prohibits acts including demotion, termination or denying the employee the original position, or a position equivalent to their previous position upon returning.

Leave of Absence

The Illinois Employee Sick Leave Act allows employees to take sick days provided by their employer to accompany a family member who has a medical appointment and/or to care for an injured, or sick family member. This law only applies to employers currently maintaining internal sick-leave policies: An employer is permitted to limit an employee’s use of sick leave. However, while employers may choose to provide employees with additional leave benefits, they are not a requirement of this law.
